It doesn't seem like it would be too hard to learn to ask permission since this is happening over and over (a couple of photos I took at Macworld in 2006 were used without my permission in thousands of copies of the exhibitions and events guide at Macworld 2007 http://flickr.com/photos/ari/351048901/in/set-72157594469020893/ ). It looks like they've communicated with Thomas Hawk since his photo is back up with a credit.
